Can I change my mind?

The Dealer Won't Cancel My Warranty

By Omar Arteaga — CheckMyCarDeal·Updated October 24, 2026

Go around them: send your cancellation directly to the contract administrator named on your service contract — in most cases a dealer can't simply refuse a cancellation the contract allows. If that stalls, climb the ladder in writing: office manager, general manager, administrator, your lender, the state attorney general, and the state dealer board.

Rules vary. Refund windows, cancellation fees, and refund rules vary by contract and by state. Check the cancellation terms in your own contract — they control. This page is general information, not legal advice, and no specific refund amount or outcome is guaranteed.

What “we can't cancel that” usually means

The escalation ladder

1

Business office manager

Send a written request (or resend your first one) to the finance office or business office manager with a deadline: 10 business days.

2

General manager

If the deadline passes, send the escalation letter below to the general manager. Copy the administrator and your lender.

3

The administrator, directly

Call the administrator's cancellation department (the name and phone number are on the contract) and send your request to them in writing. Ask whether a dealer signature is required — many process requests directly.

4

Your lender

The refund is supposed to come to your loan. Tell the lender you cancelled and haven't seen a refund; some lenders will follow up with the dealer or administrator.

5

State attorney general

File a consumer protection complaint. Attach the contract, your requests, and your log.

6

State dealer board / insurance department

Complain to the agency that licenses dealers in your state. In many states, service contract providers and gap coverage are overseen by the state insurance department — file there too.

7

Attorney or small claims

For a refund the dealer still won't process, small claims court or a consumer protection attorney is the last step.

On [date of first request] I requested cancellation of the contract above, as its cancellation terms allow. A copy of that request is attached. As of today I have not received confirmation or a refund.

Please confirm the cancellation in writing and tell me the refund amount and the date it will be issued, within 10 business days of this letter.

If I do not receive a response by [date], I will file complaints with the [State] Attorney General, the [State] dealer licensing agency, and [State insurance department, if applicable].

Keep a log

Every call: date, time, who you spoke with, what they said. Every letter: the date sent and how (email, certified mail tracking number). Regulators act faster on a clean file.

While you wait, keep making your loan payments — a pending cancellation doesn't pause the loan.

Next money move: your rate

When the refund lands, your balance drops. See what a lower rate would change on what's left.

Common questions

Can a dealer refuse to cancel my extended warranty?

If your contract allows cancellation, the dealer generally can't just refuse — and the administrator usually processes it. Send your request to the administrator directly and keep copies. Rules vary by contract and state.

How long should a refund take?

Often several weeks. If you haven't received written confirmation within about 30 days, follow up in writing and start climbing the ladder.

Who regulates service contracts and gap coverage?

It varies by state. Many states oversee service contract providers through the insurance department; dealers are licensed by a dealer board or the state motor vehicle department; the attorney general handles consumer complaints.
